A needed career change and possible lawsuit

    After 18 years as a dealership technician, I finally brought my tools home. I'm done with this profession. And, I was fired for the first time in my life. Our service manager is the type of guy that can't or won't listen to anyones advice or opinions. he's never in the service department to manage. and with the experience i have, I'm everyones 'go to' guy. the last few months i've grown really tired of doing someone elses job and I have'nt been so "helpful" to everyone else. I was flat rate, and the time I spent helping others does'nt pay. I have a baby on the way, and I've been more concerned with my own responsibilities than helping others grow. well, our manager has'nt been in the greatest mood because of this.
    he's had to do a lot more work. plus I stirred up a hornets nest when I told them if they didnt get an exhaust system installed I was going to call osha. (the exhaust is mandated by law) My friend used to work with me got fired after he called them the first time. we had no exhaust since I started there. he called osha, the workplace got fined and they installed the exhaust system. well over a year ago they installed a few new lifts and took the system apart and rendered it useless. they never got around to hooking it back up. I repeatedly told them about it and it got put off again, and again. well, I went through yet another winter with the doors closed breathing carbon monoxide. I started having chest pains, blinding headaches, and even passed out a few times seemingly for no reason. I went to a heart specialist and found out I have an enlarged heart, and high blood pressure. The doctors will not say the carbon monoxide is the root cause. but, I know without a doubt thats what caused it. well what started the big explosion was tuesday I got to work, and immiediately had to help one of the guys with one of our used cars. the service writer was yelling and screaming and calling the owner an idiot, and a stupid ass because the car had already been diagnosed, and a part was on order. so I walked away and went to work. I got my first repair order written by the service manager and it stated the left rear window was stuck in the up position. it also said "see history". I checked the history and found someone had replaced the left front window regulator and motor. Obviously not related to the current complaint. I got in the car and found both the front windows were down, and both rears were in the up position. I rolled them down and the left rear worked, but it popped before it came down, and made a grinding noise on the way down. I found the runs (the channel the window slides in) dirty and sticky. I cleaned, and lubed them and cleaned the window. I charged the customer next to nothing and turned the ticket in. I also told the manager I heard a rattle in the left front window when I closed the door. I went back to work in my stall. as soon as i got back one of the other guys needed help lowering a differential from a vehicle. I was holding a heavy part over my head when the service manager came to me and told me he wrote the wrong door on the ticket. and he wanted me to look at it again. since the ticket was closed. this would be free of charge. since I charged them so little, and someone else had installed the regulator and messed it up, and the fact my hands were tied. I told him to give it back to the guy who originally worked on it or he'd have to do it himself, or write another ticket so I could get paid for it. He got pissed, stormed off and worked on the car himself. for the next hour he treated me like crap. I walked by him on my way to the bathroom and he started cussing at me and talking down to me. I told him I didnt appreciate the way he was treating me, and I dont have to put up with it. he then got in my face. literally spitting mad yelling at me. I turned away but didnt back up when i felt him spitting on me. I was about to clock him !! then since i turned my face he pushed me! I snapped I started yelling back at him and told him in these exact words "dont ever put your hands on me again, PLEASE! the general manager walks around the corner from outside and asks the service manager who was yelling. The guy pointed at me, and the general manager said YOUR FIRED! I confronted the service manager and said tell him the truth. I had my fist doubled up and i was going to put him to sleep if he lied. But he told him. yes we were both yelling. and, I still got fired. Point is, It was awful easy to fire me since I threatened to call osha, and made them repair the exhaust. Now, I have no insurance, and I have to drive an hour and a half to see my doctor. they left me with a heart condition, and no way to pay to get it fixed. I'll be seeing a lawyer soon, and I'm looking for a different line of work. I'm tired of dealership life. we have to study and go to school like doctors. and were treated like grease monkeys at walmart by the general public, our employers, and the car makers. cars change every year. the human body has'nt changed in thousands of years. I picked the wrong career! If any of you younger people out there reading this are thinking about a career in the automotive industry. Think again! I've wasted my life with it and I'm finally moving on. dont make the same mistake.

    Mark,I know it seems bad,But I don't think getting fired over threatnin to call OSHA would be a just cause:wink:if you can prove that had anything to do with thier dec.it might be in your favor. Also,I wouldn't have been so nice to the guy or the manager,I would have probably got my arse whupped,But both of em would darn sure KNOW WHO I AM.

    You definetly have a strong case, get a good lawyer and call osha, and pop a physical assult charge on the moron that pushed and threatened you.

    Mark I like the own shop idea....People here in southern IN are looking to save a lil cash on the auto repairs. Got a couple buddies make a good living out of pocket, cash in hand, and barter. One buys cars, repairs them, and sells em. Lot of "Starving Marvins" out there need safe transport. These guys stay busy just word of mouth. The dealerships are for the well ta do.
    See if there is a state agency for safety. They can be a bigger pain in the ass than the FEDS.
    Hope things get better for ya. What happened to ya is why business hates unions. WHERE DO YOU GET OFF WANTING SAFETY AND FAIRNESS!

    I would keep a journal of everything, and also who saw it go down in case you need witnesses. I would also after talking to a lawyer, make it extremely publicized. I would think that after a while of not selling cars or whatever, that they might be a little more socialable to you. Whatever you decide to do you do NOT have to take that form of abuse. On the other hand as a highly trained mechanic, there are probably shops out there that would dearly love to have a qualified mechanic in the house. Good luck to you. Later Andy

    i know that if you can work on foreign cars you would make a killing in mt vernon. i know you said you want to do something different, but its an option. the only guy who did foreign cars here retired and everyone who drives them has to go to the dealer now.

    If you make any unwanted physical contact with another human it's battery. you don't have to throw a punch. He did'nt hock back and spit on me. he was just so steaming mad that he was spitting as he talked. and he didnt shove me with his hands but rather his chest. It's still battery. I was'nt afraid of him. More afraid of what I was gonna do if i lost control. And it was a lot more than a threat to call osha, I made them spend money and showed them they had to play by the rules when they dont want to. They didn't want me around once they seen I was gonna stand up for my rights. It just burns my ass to see the shop turn into a place that thinks they can do anything in the name of business. The only way I'll retire from repairing cars is to start my own business. I'll never work in another dealership. do all of you know that there are 2 different pay scales? there's a scale for warranty repairs. and a scale for customer pay. A job that pays 8 hours customer pay, may only pay 3.5 hours warranty. even the manufacturer can rape the flat rate tech. and there's nothing we can do about it. except try to finish it and move on to something else. a task that's greatly hampered by a poor run shop. finding special tools, dealing with your parts department, communications with your service writers, etc, etc. I'm just tired of it. I think I'll just work on my own for awhile. and maybe build a wall or 2 for awhile till i figuer out what i'm gonna do. or maybe i'll just go fishing, LOL

    a 30 year old buddie of mine here in town did just that after sweating for some one else for some time. he built a 12' wall garage with a lift. hes been doing it now for 4-5 years. stays busy and takes more vacations now than he did before. good luck mark.

    Oh yeah, dealerships suck for sure. you did the right thing. Now talk to the other techs. No difference in the boating world.

    Publicity is a great tool:wink:

    There are couple in my area that I use who are honest and they know what their doing.
    Also when I do it my self, they dont mind giving me tips.
    Only problem is, everybody wants to use them. They have plenty of business..
    heck sometimes, minor stuff, they dont even charge. They sometimes tell me what is wrong and how to fix it myself cause they are so busy.
    good honest fair price Mechanic is worth a lot now days.
    You will probably make more money than at a dealership.

    Anyway, it sounds like a boss like yours should be fired.

    I only use dealership for under warrenty fix's and recalls.
    They charge too much for what is done.
    I'm glad we still have Self owned Mechanic. Shops.

    Doesnt matter if he hacked one up or just spit while yelling. If his spit contacted your eye for example because he was in your face and he has hiv it could infect you. Better safe than sorry.

    Ozzy is right.Even other diseases can be spread that way Hep for example.

    I would make him submit to the blood tests just as a way to say Bite me lol.

    Not to mention the newspapers would eat that up :smile2:
